General Terms and Conditions of Sale
These terms and conditions regulate the sales contract between the buyer of the ricciolibiondi.it online store (hereinafter referred to as the 'Buyer' for the sake of clarity) and Riccioli Biondi srl Via Mentana, 108 – 43121 Parma Italy. VAT number/tax code 00623690344 (hereinafter referred to as 'Seller')
1. Contents of the general conditions of sale
The following general conditions of sale regulate all sales contracts concluded between the Buyer and the Seller through the ricciolibiondi.it website. Each contract is subject to the general conditions of sale published on the site at the time the contract is concluded (see art.3). When we talk about 'Buyer' we refer to any natural and/or legal person who acts on ricciolibiondi.it for purposes not related to their commercial, entrepreneurial or professional activity, if any. If you are not a 'Buyer', we invite you to refrain from concluding commercial transactions on ricciolibiondi.it. Any modification proposed by the Buyer is not capable of changing the general conditions of sale, unless expressly accepted in writing by the Seller.
2. Parties to the contract and geographical area
The ricciolibiondi.it online store is intended for the exclusive use of consumers, i.e. it is reserved for retail sale. Complaints regarding the site and delivery to the final Purchaser's home must be addressed to the Seller. The products offered for sale through ricciolibiondi.it will be delivered to Buyers who will indicate as the delivery address an address located exclusively in Italian territory.
3. Finalization of the contract
All product information on ricciolibiondi.it, such as technical specifications, images, dimensions or compatibility details are non-binding and are subject to change at any time, unless expressly identified as binding. In the event that the Buyer is misled in the purchase by the aforementioned indications, he may exercise the withdrawal referred to in the Right of Return and Withdrawal paragraph. The offers on ricciolibiondi.it are not binding for the Seller and do not constitute an offer to the public, but a simple 'invitatio ad offerendum'. The Purchaser's Purchase Order has the value of a binding contractual proposal. The Purchase Order is accepted by the Seller with an Order Receipt sent via e-mail, which contains an extract of the conditions of sale, the description of the characteristics of the product ordered, the essential elements of the contract (price, methods of payment), the systems set up by the Seller for archiving the order and storing the data, the procedures for correcting the message containing the order. The contract is perfected and comes into force when the Buyer receives the Order Receipt. The Order and the receipt of the Order are considered received when the parties to whom they are addressed have the possibility of accessing the electronic messages. In the event that the Buyer does not receive the Order Receipt from the Seller or any other communication from the Seller within 24 hours of placing the Order, the Buyer is required to promptly contact the seller via the address: info@ricciolibiondi .it in default the contract will be considered not concluded and ineffective.

4. Purchase of products
The Products displayed in the Catalog may be purchased through the prior selection of the same by the Buyer and the subsequent inclusion of the same in the appropriate cart. Once the selection of the Products has been completed and wanting to proceed with the purchase of those included in the cart, the Buyer will be asked to provide the requested data on the Site in order to allow the completion of the Contract. In particular, the Buyer will be asked to provide in a specific section of the Site his/her personal data, his/her e-mail address, his/her address as well as the address where the Products are delivered (where different from the first), his/her address billing and a telephone number where you can contact him in order to possibly inform him about the delivery date of the Products. If the Buyer opts for the payment method by credit card, he will have to communicate his credit card details via a protected connection which the Seller will not be able to access. For accounting - administrative needs, the Seller reserves the right to verify the details provided by the Buyer. In the case of payment by credit card, the purchase amount will be charged to the Buyer following completion of the order on the site. In the case of an order of limited series Products, the Seller may reserve the right to allow each Buyer only to purchase a certain quantity which may be less than the total number of Products offered for sale.
5. Delivery of the goods
The indicated delivery times are not binding, unless otherwise stated in a separate agreement. However, the Seller does everything in its power to respect these times. The Seller cannot guarantee that the availability is correct in all cases. In this case, the Buyer is informed immediately that the goods will not be delivered and any payments already made by the Buyer are refunded without further delay. Upon receipt of the goods, the Buyer must immediately check that the delivery is complete and correct and inform the Seller of any problem without delay by writing to the Customer Care email address: info@ricciolibiondi.it.
6. Prices and shipping costs
The price of the Products is that resulting from the Price List published on the site on the day the order is issued and before the Order is issued. The prices indicated refer to the price of the product. Depending on the country of delivery, the costs relating to shipping will be displayed when placing the order and before completing it. Any other costs, charges, taxes and/or indirect duties that a country may apply for any reason to the products being sold will be borne by the buyer. By accepting these conditions, the buyer declares that his lack of knowledge of said costs, charges, taxes and/or indirect duties cannot constitute a cause for the right of withdrawal and cannot in any way be charged to the seller. It is the Buyer's responsibility to pay appropriate taxes, duties and other charges in his country of residence. The Buyer indemnifies the Seller from the payment of such taxes, duties and charges.
7. Payments
Orders placed on ricciolibiondi.it can be paid by credit card. The Seller may allow different payment methods in the payments section on ricciolibiondi.it. Your credit card details are sent to PayPal (Europe) S.à r.l. et Cie, S.C.A. (R.C.S. Luxembourg B 118 349) ("PayPal") which handles credit card payments on behalf of the Seller. The credit card data sent during the order placement to PayPal (Europe) S.à r.l. et Cie, S.C.A. (R.C.S. Luxembourg B 118 349) ("PayPal"), are protected against unauthorized access through 168-bit (or later) SSL 3.0 (Secure Socket Layer) encrypted data transfer. All current browsers support SSL encryption. This data is not accessible to third parties, not even to the Seller. In this regard, Riccioli Biondi srl recommends keeping the browser used constantly updated. Orders can be paid using credit cards (Visa, American Express, Mastercard) and prepaid cards (Poste Pay, Pay Pal Top-up, Carta Aura).

8. Warranty
8.1 Seller's legal guarantee
The Seller issues pursuant to and for the purposes of Directive 44/99/EC and the Consumer Code (Legislative Decree 6 September 2005, n. 206) a legal guarantee on the product in the event that it does not comply with the qualities envisaged in the sales contract. The guarantee allows the Buyer, in the event of defects in the conformity of the product, to obtain, by contacting the Seller directly, within a reasonable time taking into consideration the nature of the goods, repair (if and to the extent possible), replacement of the product, the reduction of the price or the termination of the contract. In any case, the use of the goods that does not conform to that established by the Seller/Manufacturer is not covered by the guarantee. Any complaint must be presented by mentioning the proof of purchase (tax document issued by the seller/payment).
8.2 Place to submit complaints
The complaint must be presented by the Buyer promptly and never later than 60 days from the date on which he noticed the lack of conformity. The complaint can also be forwarded by email - info@ricciolibiondi.it - to the Seller who will immediately communicate to the Buyer the methods by which to deliver the product.
9. Product liability
The provisions of Directive 85/374/EEC apply with regard to damage caused by the product. The Seller, as distributor, releases itself from any liability, none excluded and/or excepted, by indicating the name of the manufacturer.
10. Copyright
All contents on the ricciolibiondi.it website are protected by copyright. All rights belong to Riccioli Biondi srl. This website cannot be: reproduced either in whole or in part, transferred by electronic or conventional means, modified, linked and used for public or commercial purposes without the prior written consent of Ricccioli Biondi srl.
11. Applicable law and place of jurisdiction
The applicable legislation is Italian, but the Buyer cannot be denied unavailable rights deriving from the legislation of his country.
Any dispute, deriving from or in any case connected to these "General Terms and Conditions of Sale" will be referred to the jurisdiction of the Court as defined by the rules contained in the Consumer Code (Legislative Decree 6 September 2005, n. 206). If relationships between Professionals exist between the Parties, the Parties, by accepting these Conditions of Sale, agree and accept to elect the Court of Parma as the exclusive competent court.
12. Final provisions
If any of these general terms and conditions prove invalid or become invalid at a later date, this will not affect the validity of the remainder of this contract. In such case, the invalid term is replaced with a term that most closely represents its economic intent and purpose or with appropriate legal provisions. Therefore the Parties agree and accept that the invalidity of a term and/or condition is not a substantial legal element for the purpose of the annulability or nullity of the agreement since they declare that it is without prejudice to good faith in the execution of the contract and the fact that the Parties could not have known this invalidity at the time of concluding the agreement. The Seller reserves the right to amend these general terms and conditions at any time. The amended general terms and conditions are made accessible on the ricciolibiondi.it website.

13. Security
User data is protected to the extent permitted by us against loss, falsification, manipulation and misuse by third parties. Furthermore, the Seller uses services capable of guaranteeing the highest levels of reliability and security to ensure customers that the site is protected and that information sent via web browsers or other devices remains confidential. 14. Right of Return and Withdrawal
Purchase of products
For any reason he is not satisfied with the purchase made, the Buyer will have the right to withdraw from the Contract, without any penalty in terms of cost incurred for the product, therefore with the exception of shipping and transaction costs incurred by the Seller which will be retained by the Seller himself and will remain the sole responsibility of the Buyer. The Buyer may exercise the right of withdrawal, within the peremptory deadline of 15 working days from the date of delivery of the order through the procedure specified in the specific section of the site "Return conditions ", and in any case by sending a registered letter with return receipt (or telefax, telegram, telex, email, provided that there is confirmation via registered letter with return receipt within the following 48 hours, or even email via certified e-mail if both parties have certified mail ) to the Seller's headquarters within 10 days of delivery of the goods. In order to allow the regular and rapid reimbursement of the cost of the product, you are asked to complete the Return Form, in order to obtain the corresponding Return Code (RMA). The return of the products must be carried out, at the sole expense of the Buyer, to the following address:

The Products must be returned in the same conditions as they were received, i.e. in perfect condition, complete with all their elements, unused, provided with the original packaging and any attached manuals. It is understood that the transport risks for returning the Products will be borne entirely by the Buyer. The Seller will take delivery of the returned Products, reserving the right to verify that they have been returned as delivered to the Buyer. To this end, it will be advisable to cover the original packaging of the Products with other protective packaging that preserves its integrity and also protects it from writing or labels.
The Seller will reimburse the Buyer free of charge for the entire amount paid for the purchase of the Products, with the exclusion of transport contributions and contributions for any duties, within the time limits established by law, and provided that the Products have been returned in accordance with the above provisions. The aforementioned refund, subject to quantification of the amount, will be made by bank transfer to the Buyer. It will be the Buyer's responsibility to communicate to the Seller, by completing the appropriate form, the bank details to make the transfer to him and to ensure that the Seller is able to return the sum due.
15. Force majeure
The seller is exempt from all liability for the total or partial failure to fulfill any obligation set out in these General Conditions of Sale if such failure is caused by unforeseeable events and/or natural events beyond the control and responsibility of the Seller including, a by way of example but not limited to, natural events (disasters), acts of terrorism, wars, popular uprisings, connectivity malfunction, lack of electricity, general strike of public and/or private workers, strike and/or traffic restrictions of couriers and air connections.
